Used or existing parts — acknowledgment and limited release

When a customer authorizes installation or continued use of used, previously installed, or reconditioned trailer parts, the specific parts and customer authorization will be documented in the service agreement.

Parker Trailer Services does not guarantee the remaining service life of these parts or that they are free of hidden defects, prior damage, or wear. These conditions may cause component failure, an accident, property damage, or personal injury.

To the extent permitted by Texas law and agreed in a signed service agreement, the customer releases Parker Trailer Services from the customer's claims arising solely from failure of the identified parts due to preexisting wear, damage, or hidden defects, provided the failure was not caused or contributed to by the company's negligent inspection, installation, repair, or other work.

This limited release does not cover negligent workmanship, gross negligence, intentional misconduct, or rights that cannot legally be waived. It does not authorize installation of parts known to be unsafe or certify the entire trailer as roadworthy.

This website notice does not itself create a signed release or waive an injured third party's rights. Any limited release must be documented separately in the customer's signed service agreement.

Texas sales tax notice

Parker Trailer Services generally provides repair and maintenance labor using parts purchased and supplied directly by the customer. Labor to repair, maintain, or restore a trailer—including replacement of worn, damaged, or defective components—is generally not subject to Texas sales tax under Texas Tax Code § 151.0101(a)(5)(C) and 34 Texas Administrative Code § 3.290.

If Parker Trailer Services sells separately itemized parts, performs taxable trailer remodeling, or installs added accessories, applicable Texas state and local sales tax will be charged as required by law. Customer-supplied parts do not exempt otherwise taxable remodeling or accessory-installation labor. Valid tax exemptions will be honored upon receipt of required documentation.

Legal authority: Texas Tax Code §§ 151.0101(a)(5), 151.051, and 151.052; 34 Texas Administrative Code § 3.290.
